The Role of the Precautionary Principle in the Legal Transplantation of an Environmental Law Institution

The precautionary principle, as one of the foundational principles of environmen-tal law, is grounded in the idea that the state is under a duty to adopt measures aimed at environmental protection where there is a risk that a particular activity may cause environmental harm, even in the absence of full scientific certainty that such harm will occur. Although the underlying idea of precaution can be found across legal instruments governing various aspects of environmental pro-tection, its transformation into a general principle of environmental law followed a distinctive trajectory, from German law to international legal instruments, in which it was further elaborated and defined.
At the same time, environmental impact assessment developed in the United States as a legal mechanism capable of responding comprehensively to the need to reconcile social development with environmental protection. Owing to its effec-tiveness and broad practical reach, this mechanism proved particularly suitable for implementation in national legal systems, and its transplantation through in-ternational law consequently met with wider acceptance. Today, the precaution-ary principle is reflected in environmental impact assessment and in the use of best available technologies, techniques, and equipment.
This paper offers a comparative analysis of the development of the precautionary principle and environmental impact assessment, and examines the significance of the precautionary principle for the successful legal transplantation of environ-mental impact assessment. Finally, it provides an overview of the distinctive role played by the banking sector in linking the precautionary principle and environ-mental impact assessment into a unified concept.
