Најбољи интерес деце родитеља на извршењу казне затвора

Рад се темељи на анализи заштите најбољег интереса деце родитеља на извршењу казне затвора у Републици Србији. Циљ истраживања је да се установе механизми и правни оквири за заштиту те деце, посебно применом начела најбољег интереса. Анализом релевантних закона и правних стандарда који се тичу права детета и особа на извршењу казне затвора, у раду се откривају изазови са којима се ТА деца суочавају током одрастања. Резултати истраживања показују да је начело најбољег интереса детета недовољно јасно дефинисано, што се посебно односи на очување редовних непосредних контаката између деце и родитеља на извршењу казне затвора. Истиче се важност унапређења сарадње између стручњака у области социјалне заштите и кривичноправног система, као и њихове континуиране едукације како би се обезбедиле адекватна подршка и заштита те рањиве групе. С тим у вези, потребно је унапредити законе, политике и праксе које се односе на децу чији су родитељи у затвору, како би се обезбедиле ефикасна правна заштита и подршка у реализацији начела најбољег интереса.
