Казна доживотног затвора, људска права и правда заснована на доказима у ери укидања смртне казне

Како све већи број држава напушта примену смртне казне, доживотни затвор постаје њена најважнија алтернатива, што отвара простор за продубљену анализу њеног појмовног одређења, правних оквира и импликација по људска права. У раду се разматрају различита нормативна решења и културне перспективе, уз посебан осврт на пораст ослањања на ову санкцију у контексту напуштања смртне казне на глобалном нивоу. У том светлу, супротстављање пеналног популизма и кривичноправне политике засноване на доказима нуди важан увид у то како јавно мњење може обликовати кривичноправни дискурс. Док пенални популизам неретко фаворизује перцепције и очекивања јавности науштрб емпиријских налаза, приступ заснован на доказима наглашава потребу за темељном анализом, стручном проценом и ослањањем на релевантна истраживања при обликовању казнене политике. Коначно, савремено сагледавање казне доживотног затвора укључује и разматрање могућности рехабилитације и реинтеграције, уз балансирање етичких дилема, нових тенденција и обавезе заштите људских права. Рад указује на сложен и вишедимензионалан карактер ове казне и важност њеног промишљеног уређења у складу са савременим схватањима правде и хуманости.
