The Right of Asylum – Origin, Historical Development and the Modern Concept of Asylum

In this essay, the author will describe the origin and development of asylum by studying norms and institutions from legal history, both general and partly national, especially with regard to individual provisions from the Middle Ages. The development of asylum from the earliest periods of human society's past, up to the period of the new century, and the significant changes that this legal institution has undergone, due to the development of state sovereignty and absolute monarchies, as well as the weakening of the Catholic Church, will be presented. The author will also describe diplomatic asylum in more detail, as a phenomenon that emerged with the development of diplomacy, and is today largely accepted as a regional custom in Latin American countries, although it is sporadically applied outside that geographical area. Regarding the modern concept of asylum, the author identifies the problems that legal systems and asylum seekers face, primarily in the field of so-called "ecological migrants", for which a potential positive legal solution will be presented. The norms related to asylum adopted during the COVID-19 in Republic of Serbia pandemic will also be studied, from a historical and legal perspective.
