Иако се достојанство божанства у упоредном законодавству више углавном не сматра подобним објектом кривично правне заштите, у савременим правним системима се и данас срећу кривична дела којима се штите верска осећања грађана. Међутим, налик другим кривичним делима која повређују част и углед, противправност таквих понашања често се доводи у питање ако је увредљиво излагање имало критичку ноту, нарочито уколико је било изнето у оквиру неког књижевног или уметничког дела. У раду се приказује врло богата упоредна судска пракса националних судова и Европског суда за људска права која се односи на бласфемно изражавање, као и релевантни међународни документи.
