QUINQUEVIRI, THE SELECTION OF JURISPRUDENTS IN THE LEX CITATIONIS

The subject of this paper is, firstly, to investigate the cause of the selection of jurisprudents in the Lex citationis. The author examines the question why this constitution was necessary for the postclassical Roman legal system, as well as what led to the selection of the five lawyers (Quinqueviri): precisely, what was the unbiased justification of the selection. This can be found in the litigation practice of the time, but also in the representation of the Quinqueviri’s quotes in previous attempts of codification of positive Roman law. Sources of law in the postclassical period of Roman legal history were divided into leges (rules made by the emperor) and ius (jurisprudential legal solutions, most often casuistic). So, with these inconsistent sources, especially ius which could be contributed to by numerous jurisprudents, an extensive codification was needed. Bearing in mind that the goal of adopting this constitution was to regulate the validity of ius, the manner in which that function is performed is also checked in the paper. By investigating the content of Digest and the number of fragments statistically distributed by authors, this paper finds out the influence which the Lex citationis had on this codification which is said to be one of the most important legal works ever done. Furthermore, the Lex citationis emphasizes the most appreciated Roman jurists whose work would be taught for centuries to come, so it makes the foundation for the study of the most influential products of Roman jurisprudence. Finally, the paper explores the most important and intriguing parts of the Quinqueviri’s biographies which are key for understanding their importance for the development of Roman law.
