Socijalna ontologija Džona Serla kao paradigma za empirijska istraživanja prava

Apstrakt

Razumevanje prava kao specifične društvene činjenice – institucionalne – kod neoinstitucionalista poput Nila Mekormika i Ote Vajnbergera, predstavljalo je značajan zaokret u jurisprudenciji. Makar u delu pravne teorije napušten je voluntarizam, a lokus normativnosti prava premešten je u društvene (interakcijske) prakse. Iako je ovakvo shvatanje prava, čini se, prirodno vodilo akcentovanju njegovog faktičkog sastojka, neoinstitucionalizam je ostao pretežno analitički i normativistički. Ovaj rad je pokušaj da se skrene pažnja na to da se on mogao kretati i u drugačijem pravcu, pravcu socioloških i drugih empirijskih istraživanja prava, kao i da mu je socijalna ontologija Džona Serla od koje pozajmljuje pojam institucije, davala dovoljno inspiracije za tako nešto. U radu smo pokušali da detektujemo one delove Serlove socijalne ontologije iz kojih se mogu derivirati teme/hipoteze za sociološ- ka i druga naučna istraživanja prava, te da ukažemo na moguće pravce njihove razrade.
