Mogućnosti primene fenomenološke metode na pravne pojmove i teorije

Fenomenologija je filozofski pravac 20. veka utemeljen u misli nemačkog filozofa Edmunda Huserla koji ističe način pojavljivanja fenomena u njihovoj prvobitnoj datosti, zagrađivanjem sadržaja fenomena zarad fokusiranja na njihove suštine. Filozofsku metodu ovog pristupa autor rada tumači kao izdvajanje univerzalnih karakteristika fenomena koje se prožimaju kroz svaku pojedinačnu instancu njihovog pojavljivanja, odnosno, elemenata bez čijeg prisustva prestajemo biti svesni istih fenomena i koji time poprimaju oblik njihovih suština. Prvi deo rada bavi se utvđivanjem okvira fenomenologije i njene osnovne premise – intencionalnosti svesti, drugi je posvećen samoj strukturi fenomenološke metode, dok je u trećem delu metoda primenjena u korist približavanja univerzalnim osnovama fenomena „pravo“, prvo kroz utvrđivanje fenomenoloških elemenata Hans Kelzenove osnovne norme, a potom fenomenološkim opisom prirode pravnog uputa, usmeravajuće uloge pravne norme i uticaja pravne norme na unutrašnju i spoljašnju evaluaciju formiranjem događajnih obrazaca.
