Abstract

The aim of this paper is to analyse the process of factual reasoning in the evaluation of eyewitness testimony from the standpoint of the general theory of law and the theory of evidential reasoning, as well as through the lens of an empirical legal discipline – eyewitness psychology. Due to the neglect of the topic of factual reasoning in domestic legal theory, this paper is split into two parts. The first part will present the field of factual reasoning which deals with the process of making inferences about facts in law. It describes factual reasoning as a part of overall juristic reasoning, its relationship to legal reasoning, or rather interpretation of law, and outlines its main characteristics. Subsequently, it will describe the basic elements of factual reasoning in the form of facts, evidence and generalisations. Particular attention is paid to its relationship with determining the truth in judicial proceedings and the role of empirical legal disciplines in the process of proof. The second part will apply this knowledge to the process of evaluation of eyewitness testimony.
