Essay on criminal law and rule of law in the case of the principle of legality

The author is trying to analyse the principle of legality and legitimacy of criminal law in the contemporary context. The term contemporary context refers to the neoliberal model of the social organisation. Having in mind several levels and factors that affect the erosion of respect of the subprinciples (lex praevia, scripta, stricta,certa) the crosscheck of this statement will be conducted upon two basic models. One of them are contemporary influences on the principle of legality within the legal system (domestic and international criminal law), and the others have legal character (abuse of power and the neoliberal model of the social organisation). The conclusion is that non-legal influences are inevitable and dangerous for the existence of the principle of legality and legitimacy of the crime legislation, and they are influencing the shape and essence of the new criminal law (legislation) through the politics of accommodation and adaptation formula. The essence of the problem is that the instrumentation of the liberal criminal law (protection of value of liberty, equality and human rights) is not formally repudiated, but the contemporary context is made of the opposing post-libertarian values. Therefore the new criminal law must find new instruments efficient in functioning (or as opposed to) the neoliberal social organisation, otherwise it will become a ritual game deprived of the value component (distinguishing evil from good).
