POSITION OF WOMEN OF ANCIENT GREECE IN MARRIAGE AND FAMILY LAW

Abstract

The legal position of women in Ancient Greece differed due to the inequalities in the state and social organisation of the poleis. The position of women in society, family and marriage in Ancient Greece ranged from their complete disenfranchisement to partial equality with men. The subject of the paper are the characteristics of the legal status of women in the family (oikos) and marriage (gamos), and the analysis of the factors that influenced the creation and sustention of such a specific legal and social formation. Dowry and the crime of adultery are analysed in the paper. The author provides a comparative overview of family and marriage in three poleis: Athens, Sparta and Gortyn. The question is whether a formally better legal position necessarily indicates an equally favourable social status. The conclusion of the paper gives an evaluation of the legal status of women in Ancient Greece, viewed from the perspective of the patriarchal and class system of that time, according to the understading of the Greek spirit.
